Destination Havasu Terms and Conditions

DEPOSIT AND CANCELLATION POLICY

Total monies are due in full 30 days prior to arrival date unless other arrangements are made with Destination Havasu. A credit card (Visa or MasterCard) must be issued for payment, either written or verbally. In the event of a cancellation, a $250.00 fee will be charged. 50% of the total rents will be refunded to guests if the cancellation is made more than 30 days prior to the arrival date. If a cancellation is less than 30 days prior to the arrival date, the entire amount paid will be forfeited. In all cases of cancellation, if the property is re rented by another party under the exact terms as the original agreement, a refund of rents in full will be issued to the guest. In all cases of cancellation, cleaning fees, insurance fees, etc. are refundable. All funds paid shall be held in a non-interest bearing Arizona depository trust account payable to Destination Havasu, LLC. If any interest is earned, it will be to the benefit of Destination Havasu, LLC. 

WINTER GUESTS ONLY (November-March)

If a cancellation is less than 60 days prior to arrival date, the entire amount paid will be forfeited. In all cases of cancellation, if the property is re rented by another party under the exact terms as the original agreement, a refund of rents in full will be issued to the guest. In all cases of cancellation cleaning fees, insurance fees, etc. are refundable. All funds paid shall be held in a non-interest bearing Arizona depository trust account payable to Destination Havasu, LLC. If any interest is earned, it will be to the benefit of Destination Havasu, LLC. 

RESPONSIBLE PARTY

The person(s) listed on this reservation is considered responsible and MUST occupy the property for the length of the stay. The responsible party will be held accountable for all damages or missing items on the property. Any violation of this agreement is grounds for immediate eviction and forfeiture of all funds paid. Reservations made under false pretenses are null and void and check-in will not be allowed. 

PAYMENT OF NIGHTS RESERVED

The responsible party is responsible for the payment of all nights reserved regardless of the responsible parties’ actual arrival and departure. 

IDENTITY VERIFICATION

I give permission to SafelyStay, Inc., to screen my identity, and check criminal databases in order to confirm my reservation. Complete terms regarding Safely’s guest screening can be found at Terms of Service - Safely . You may receive an email from Concierge@Safely.com to complete your screening. ALL GUESTS

The booking guest MUST provide a copy of their current driver’s license emailed to Destinationhavasu@gmail.com or uploaded to your Airbnb/VRBO instant message after reservation is confirmed. THIS IS MANDATORY BEFORE YOU CHECK IN. Check-in is 2:00 PM. Check out is 10:00 AM. These times allow for necessary time to professionally clean the property. Should you stay beyond this time a $200.00 charge will incur. 

PETS

Pets are NOT permitted in or on any of the rental properties with the exception of the designated pet properties. Our staff can recommend local pet hotels for your pets if desired. Temperatures in Havasu reach 100 -130 degrees Fahrenheit, deadly to pets and service animals, under no circumstances may an animal be left alone at the property. Violation of this policy shall result in immediate termination of the rental with no refunds of rent, tax, deposits, or other monies and shall result in a $250.00 penalty per pet and additional cleaning fees. For those properties that will accept a pet, a non-refundable pet fee of $195.00 shall be charged. 

SMOKING

Smoking is NOT permitted in any home or condo. If smoking does occur, you will be liable in full for any damages done to the home, including but not limited to A/C coil cleaning and/or A/C deodorizing, carpet clean/deodorize, replacement of linens and/or smoke damaged furniture, and new paint throughout the residence.

MARIJUANA

The possession, consumption, and use of marijuana in or on the private property are EXPRESSLY PROHIBITED regardless of whether the possessor, consumer, or user has been medically prescribed marijuana. Any violation of this prohibition is a material breach of this agreement and shall result in immediate eviction in accordance with the law with no refunds of rent, tax, deposits, or other monies. Further, you agree to pay to owner a $1,000.00 cleaning fee if you violate the prohibition against possession, consumption, and use of marijuana in or on the private property. This $1,000.00 cleaning fee shall be in addition to, not in lieu of, any deposits or rents prepaid. Owner may, in owner’s sole discretion, waive the $1,000.00 cleaning fee. You shall also be responsible for any cleaning fees in excess of $1,000.00. 

CRITTERS

Please be aware during your stay you may find desert bugs, spiders, scorpions, snakes, etc. They are indigenous to our area and are to be expected. If food is left out/open on countertops during your stay you may get ants. We cannot control these critters and will not give any sort of credit, discount, or refund in the event you run into one. 

VACATION RENTAL DAMAGE PROTECTION

As a part of your reservation, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $3000.00. Any damages that exceed $3000.00 or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3000.00. Certain terms and conditions apply. 

If you do not wish to purchase the Vacation Rental Damage Protection, a refundable damage deposit of $3000.00 will be required, and a non-refundable processing fee of $50.00 will be administered. 

TRAVEL INSURANCE

Travel insurance can be purchased for unforeseeable circumstances. The current premium is 6.5% of the total resort cost. Ask your reservation specialist if this might be of interest to you. 

COVID CANCELATION POLICY

In response to travel uncertainty, our cancellation and refund policy has been updated to match that of Airbnb and VRBO, with the additional ability to postpone dates or receive credits for future visits. Covid refunds will only be provided through travelagencies, not Destination Havasu.

KEYS/TOWELS

Each home is coded/keyed individually. There will be a $25.00 charge for each key not returned. Should new locks need to be installed, the guest will be responsible for all charges including additional keys. All original keys must remain. Duplicating or copying of keys is prohibited. 

Pool towels belong to the individual owner of the home. Please be considerate and do not take pool towels on your boat or off of the residence. Pool towels are there for your convenience; please do not use them to dry your boat. 

ENTRY OF PREMISES

Repairmen authorized by Destination Havasu, LLC may enter the premises as necessary, for repairs, improvements, housekeeping and property management. The unit you have rented may be listed for sale at any time. There is always a possibility that you will be contacted and requested to show the home at a convenient time. 

UTILITIES IN WINTER (30 DAYS PLUS)

Electrical/gas (excluding pool and spa), water, sewer and trash service are all included in the rates. Should the electrical/gas service exceed $100.00 per monthly billing cycle, the balance will be charged to the guest, applicable for extended stays only. Any Pay-Per-View, long distance calling or premium paid services charged to the home will be billed to the guest. Please keep in mind all billing cycles run differently; you may receive the bill 3-4 weeks after your stay. Internet and phone service are not available in all homes.

Water, sewer and trash, wifi, and standard cable service are all included in the rates. Electrical/ gas, including pool and spa, will be charged to the guest. Any Pay-Per-View, long distance calling or premium paid services charged to the home will be billed to the guest. Please keep in mind all billing cycles run differently; you may receive the bill 3-4 weeks after your stay. 

HEATING

NOT ALL OF OUR POOL INVENTORY CAN BE HEATED, PLEASE CALL OUR OFFICE IF YOU HAVE QUESTIONS.

The guest is responsible for ANY and ALL gas/propane used to heat the pool or spa. A meter reading shall be taken upon arrival and on departure to gauge your usage. Additional pool and spa instructions are posted in every home. If you have any questions, please contact our office. If the heater is left on, the guest is responsible for the use.

POOL AND SPA

You acknowledge that the use of spas, hot tubs, and/or pools on the property shall be at your own risk. Neither agent nor owner shall be responsible for accidents, damages, or personal injury, resulting from the use of hot tubs and/or pools.

No person under (18) years of age shall be allowed to use spas, hot tubs, and/or pools without adult supervision. Uses of recreational equipment have inherent risks for injury and/or death. 

Do not leave children or pets unattended around them. You agree to indemnify, release from liability, agree to defend, and hold harmless the agent and/or owner for any accident, injury, illness, death, loss, theft, damage to person or property, or their consequences suffered arising or resulting directly or indirectly from your use of the facilities. In the event that you, or any other persons listed under your supervision, are injured, you/they agree to assume all financial obligations for any medical costs that may occur. 

Agent and/owner assumes no responsibility for any medical expenses, injury, or damage suffered by you/yours in connection with the use of the spas, hot tubs, and/or pools. It is your intention by signing below to expressly assume all risk of personal injury, death, or property damage and to exempt and relieve agent and/owner from liability for personal injury, property damage, or wrongful death. 

By signing this agreement, you waive your right to bring any legal action now or anytime in the future to recover compensation or obtain any other remedy for any injury or death, however, caused, arising out of the use of the spas, hot tubs, and/or pools. 

You further agree that your spouse, assignees, heirs, guardians, and/or legal representative will not make any claim against, sue, or attach this property for any loss or damage resulting from the use or misuse of the facilities. 

You are aware of the potential dangers incidental to recreational activities, that this release of liability, is a waiver of your legal right to collect damages in the event of injury or death or property damage. You sign it of your own free will. You expressly agreed that this release is intended to be as broad and inclusive as the State of Arizona will allow and that if any portion is held invalid, you agree that the balance shall not be withstanding, continue in full legal force and effect. 

Cleaning is once a week, during our winky and monsoon season a pool skimmer is provided at each property for you to remove leaves and debris from nature. 

REPAIRS AND MAINTENANCE

Agent shall respond to service requests for televisions, hot tubs, appliances, etc. as quickly as possible. Neither agent nor owner shall issue rebates or refunds to you for any reason,as agent shall make reasonable good faith efforts to ensure the property is maintained to the highest standard. 

Agent cannot guarantee against mechanical failure of heating, air conditioning, appliances, TV’s/VCR’s/DVD Players/Blu-Ray Players, stereo equipment or pools/spas. Agent is not responsible for any circumstances beyond our control such as disturbances on nearby properties, construction noise, or acts of nature. Please report any inoperative equipment to agent promptly. We will make every reasonable effort to have repairs done quickly and efficiently. NO REFUNDS OR RENT REDUCTIONS WILL BE MADE DUE TO MECHANICAL FAILURES OR MALFUNCTIONS, EARLY DEPARTURE, INTERRUPTIONS OF UTILITIES, MAINTENANCE PROBLEMS, OR CONSTRUCTION IN THE AREA. Due to covid and lockdown restrictions, many local wifi services are unable to do house calls or service calls involving wifi going out. 

INDEMNITY

You shall defend, indemnify, and hold harmless owner and its respective officers, directors, contractors, agents, affiliates, and representatives against any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses that may arise from any injury that may occur upon the property during the term of the rental, except in the case of personal injury caused by the intentional act of owner or its agents. 

TRANSFER OF OWNERSHIP

In the event ownership of the property is transferred from owner by any means prior to or during the rental period, the following shall apply: (A) If the transfer occurs more than sixty (60) days prior to the arrival date, owner may, but shall not be required, to assign this agreement to the new owner, and if not so assigned, agent may in agent’s sole discretion, provide you with a comparable rental property or shall, if no alternative rental property is provided, return all monies tendered by you. (B) If the transfer occurs sixty (60) days or fewer prior to the arrival date or during the rental period,owner shall assign this agreement to the new owner, unless otherwise approved by you. Any assignment pursuant to this section shall bear the signature of the new owner indicating its acceptance of the assignment.

WAIVER

You shall not hold owner responsible for any inconvenience, damage, injury, or loss to persons or property that are caused, directly or indirectly, by persons or circumstances beyond the direct control of owner. You shall not hold agent responsible for any inconvenience, damage, injury, or loss to persons or property that are caused, directly or indirectly, by persons or circumstances beyond the direct control of agent. 

ADDITIONAL INFO

It is expressly understood that the property owner and/or booking specialist shall not be liable for damages or injury to the guest, invitees of the guest, or guest’s property for whatever cause arising from the occupancy of the said property by the guest. Rates, taxes, website details or any posted details including but not limited to parking, utilities, décor, etc. are liable to change without notice. Tax and service fees are not included in the nightly rate. Cleaning fees will be charged to every reservation. 

Please recognize that you are staying in a residential neighborhood. Your neighbors are not on vacation and are entitled to quiet peace and enjoyment. Please extend common courtesy and refrain from excessive noise and disrespectful behavior. If guest’s behavior results in a police phone call you will forfeit all monies and be asked to leave the residence. Each property reflects the personal taste and lifestyle of the owner. Each property will be completely equipped for rental purposes. We cannot be responsible for aesthetic conflicts. Special requests must be made at time of booking. 

Destination Havasu, LLC is a licensed Arizona real estate brokerage, managing privately owned homes and condominiums. Although problems are rarely encountered, we reserve the right to change accommodations up to and including the day of arrival. In the unlikely event we are not able to provide accommodations without an increase in rent, the guest will have the option of paying the increased rent or the reservation will be cancelled and all deposits will be refunded to the guest with no further rights or obligations between Destination Havasu, LLC and the guest. 

ASSIGNMENT

This agreement shall be binding upon and shall ensure to the benefit of the parties, their respective heirs, personal representatives, successors, and assignees. You shall not assign this agreement, or any interest therein, or payments due under this agreement, without the written consent of owner, except as otherwise provided herein. You shall not sublet or license to any third party any portion of the real, personal, or intangible property subject to this agreement, or any rights hereunder without the written consent of owner, except as otherwise provided herein. Any such unauthorized assignment, sublease, or license shall be void and of no effect.

INDEMNITY
